AgentDuty, LLC (“AgentDuty,” “we,” “us,” or “our”) is committed to protecting the privacy and security of your personal information. This Privacy Policy (“Policy”) explains how we collect, use, disclose, store, and protect information about you when you access or use our mobile application, website, and related services (collectively, the “Platform” or “Application”), which facilitates connections between licensed real estate professionals known as Booking Agents and Servicing Agents. By downloading, installing, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to the practices described in this Policy. If you do not agree with this Policy, please do not use the Platform.

This Policy is incorporated into and forms part of our Platform User License Agreement (the “Agreement”). Capitalized terms used but not defined herein shall have the meanings ascribed to them in the Agreement. We may update this Policy from time to time, and changes will be effective upon posting the revised version on our website or within the Application, with the updated effective date indicated above. Your continued use of the Platform after such changes constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.

1. Information We Collect

We collect various types of information to provide, improve, and secure the Platform’s functionalities, ensure compliance with licensing requirements, facilitate user connections, process payments, and comply with legal obligations. The information we collect falls into the following categories:

Information You Provide Directly
When you create an account, use the Platform, or interact with its features, you may provide us with:

Personal Identifiers: Full name, email address, phone number, username, password, and other login credentials.
Professional Information: Real estate license details (e.g., license number, issuing state/territory, expiration date), brokerage affiliations, professional certifications, and access to Multiple Listing Services (MLS).
Contact and Profile Information: Mailing address, profile descriptions, availability preferences, and any other details you include in your user profile or communications.
User Content: Text, graphics, images, postings, service requests, messages, feedback, ratings, or other contributions you submit through the Platform (e.g., booking requests or service offers).
Payment Information: Billing details, such as credit card numbers, bank account information, or other financial data, which is collected and processed primarily by our third-party payment processor (currently Stripe) as described below.
Verification Information: Documentation or details submitted for identity and licensure verification, such as government-issued IDs, license certificates, or background check consents.

Information Collected Automatically
As you interact with the Platform, we may automatically collect:

Device and Usage Data: Information about your mobile device or computer, including device type, operating system, browser type, IP address, unique device identifiers, MAC address, advertising IDs, and app version. We also track usage patterns, such as pages viewed, features accessed, session duration, timestamps, clickstreams, error logs, and navigation paths.
Location Data: Approximate or precise geolocation information (e.g., via GPS, IP address, or Wi-Fi signals) to enable location-based services, such as matching Servicing Agents near requested tasks or verifying jurisdictional compliance. Location services may be enabled based on your device settings.
Tracking Technologies: Data from cookies, web beacons, pixels, local storage, and similar technologies to recognize you across sessions, analyze trends, administer the Platform, and deliver personalized content. These may include session cookies (temporary) for essential functions and persistent cookies for analytics.
Log and Analytics Data: Server logs capturing access times, referral sources, and performance metrics. We use tools like Google Analytics or similar services to aggregate and analyze this data.

Information from Third Parties
We may receive information about you from external sources, including:

Verification Partners: Data from third-party services used for identity, licensure, or background checks (e.g., licensing boards, databases, or verification platforms).
Payment Processors: Transaction details from Stripe or other processors, such as payment confirmations or dispute information.
Other Users: Feedback, ratings, or reports from Booking Agents or Servicing Agents about your interactions.
Public Sources: Information from publicly available records, such as real estate licensing databases or professional directories, to verify your credentials.

If you choose not to provide certain information, some features of the Platform may be unavailable or limited.

2. How We Use Your Information

We use the collected information for the following purposes, always in a manner consistent with this Policy and applicable laws:

Providing and Operating the Platform: To create and manage your account, facilitate connections between Booking Agents and Servicing Agents, process service requests, enable communications, and deliver core functionalities like matching and notifications.
Verification and Compliance: To confirm your identity, licensure status, and eligibility as a Licensed Real Estate Professional, ensuring adherence to Real Estate Standards and preventing unauthorized access.
Payment Processing: To facilitate transactions, including billing Servicing Agents, handling disputes, and complying with financial regulations (primarily via Stripe).
Improving and Personalizing the Experience: To analyze usage patterns, troubleshoot issues, develop new features, customize content (e.g., location-based recommendations), and enhance user interface and performance.
Security and Fraud Prevention: To detect, prevent, and respond to security incidents, fraud, abuse, or violations of the Agreement, including monitoring for prohibited activities.
Communications: To send service-related notices (e.g., account updates, confirmations), promotional materials (if you opt-in), or responses to your inquiries. We may use email, push notifications, or in-app messages.
Analytics and Research: To generate aggregated, anonymized insights for internal research, business intelligence, or Platform improvements (e.g., understanding user demographics or trends in real estate tasks).
Legal and Regulatory Compliance: To fulfill legal obligations, respond to subpoenas, court orders, or government requests, enforce our rights, or defend against claims.
Marketing and Advertising: With your consent, to send targeted promotions or ads about our services or partners, or to measure campaign effectiveness.

We do not use your information for automated decision-making that produces legal effects or similarly significant impacts without human oversight.

3. How We Share Your Information

We do not sell your personal information. However, we may share it in the following limited circumstances:

With Service Providers: To third-party vendors who assist us in operating the Platform, such as hosting providers, analytics firms (e.g., Google Analytics), verification services, payment processors (e.g., Stripe), or IT support. These providers are contractually obligated to use your information only for our purposes and maintain confidentiality.
With Other Users: Limited information (e.g., your name, profile details, location, and User Content) may be shared with matched users to facilitate connections and services.
For Business Transfers: In connection with a merger, acquisition, reorganization, bankruptcy, or sale of assets, where your information may be transferred as a business asset, subject to equivalent privacy protections.
For Legal Reasons: To comply with laws, regulations, legal processes, or enforceable government requests; to protect the rights, property, or safety of AgentDuty, users, or the public; or to enforce the Agreement.
With Your Consent: For any other purpose disclosed at the time of collection or with your explicit permission.
Aggregated or Anonymized Data: We may share non-personal, de-identified data for research, marketing, or other purposes.

We require all recipients to handle your information securely and in accordance with this Policy.

4. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, loss, misuse, alteration, or destruction. These include encryption (e.g., SSL/TLS for data in transit), access controls, firewalls, and regular security audits. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your Login Credentials and notifying us promptly of any suspected breaches.

5. Data Retention

We retain your information for as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations, resolve disputes, or enforce agreements. For example:

Account information is kept while your account is active and for a reasonable period thereafter (e.g., up to 7 years for tax or audit purposes).
Verification and transaction records may be retained indefinitely for compliance.
Upon account deletion, we may retain certain data (e.g., logs, anonymized analytics) as permitted by law.

If you request deletion, we will remove or anonymize your personal information, subject to legal requirements.

6. Your Rights and Choices

Depending on your location (e.g., under CCPA for California residents or similar laws), you may have rights regarding your personal information, including:

For cookies and tracking: You can adjust browser settings to block cookies, though this may limit Platform functionality. We do not respond to Do Not Track signals.

The Platform is not intended for individuals under 18 years of age. We do not knowingly collect information from children. If we learn we have collected such information, we will delete it promptly.

8. International Transfers

The Platform is operated from the United States. If you access it from outside the U.S., your information may be transferred to and processed in the U.S., where data protection laws may differ. By using the Platform, you consent to such transfers.

9. Third-Party Links and Services

The Platform may contain links to third-party sites or integrate services (e.g., Stripe). We are not responsible for their privacy practices. Review their policies separately.
